Welcome to Genius! Your privacy is important to us. This Privacy Policy describes how we collect, use, share, store, and protect personal information when you use our mobile application (the “App”). It also explains your choices and rights. Where consent is required for a particular activity, it must be obtained separately; this policy does not replace that consent.

2. Information We Collect
a. Information You Provide Directly
- Instagram usernames you search or analyze through the App.
- Images you upload for LikePredict, image understanding, or comment, caption, and reply suggestions.
- Your email address and information you provide when contacting support.
- Purchase and subscription information needed to manage paid features. Payments are handled through the App Store or Google Play.
b. Information We Collect Automatically
- Device information, including model, operating system, IP address, and app version.
- App usage information, including features used, session duration, and frequency of use.
- Crash reports and diagnostic information.
c. Third-Party Information
We do not access private Instagram data. Profile-related information is based on publicly available information and content voluntarily submitted by users. The image-analysis features described below analyze only user-uploaded images; they do not retrieve or analyze Instagram profile photos.
d. Photos Containing Faces and Face-Related Information
Genius processes only images that users choose to upload for image-based features. These images may contain faces. We do not retrieve or analyze Instagram profile photos for these features. The information processed includes the uploaded image, its visible content, and the descriptions, suggestions, or engagement assessments generated from it. Our image analysis is used to understand image content, not to identify or authenticate individuals.
3. How We Use Your Information
a. General Uses
We use information to provide and improve the App’s features, personalize the user experience, respond to support requests, manage subscriptions, prevent fraud or misuse, and send transactional or feature-related notifications. The specific uses of uploaded images and face-related information are described below.
b. Use of Uploaded Images and Face-Related Information
We use uploaded images, including any faces visible in them, to understand their content, generate comments, captions, and reply suggestions, and assess their potential to attract social media engagement through features such as LikePredict. These assessments are AI-generated predictions, not guarantees of actual engagement. The planned uses of this image-processing flow are limited to these user-requested features.
4. Legal Basis and Permission
a. Legal Basis for Processing
For users in the European Economic Area, our legal basis depends on the activity. It may include consent, processing necessary to provide a requested service under our contract with you, or legitimate interests such as maintaining the App, subject to your rights. We obtain consent where required by applicable law.
b. Permission for Image Analysis
Before an uploaded image is sent to OpenAI for the first time, the App displays a permission pop-up explaining that the image, including any faces it contains, will be shared with OpenAI for image understanding, comment, caption, and reply suggestions, and engagement assessment. Only users who explicitly accept this pop-up can send content to OpenAI. If you decline, your content will not be sent to OpenAI and the OpenAI-powered image-analysis features will not be available to you.
You may contact instageniusapp@gmail.com to withdraw consent or request deletion. Withdrawal does not affect the lawfulness of processing based on consent before its withdrawal.
5. Sharing Your Data
a. General Sharing
We do not sell or rent your personal information. We may share information with service providers for hosting, analytics, customer support, and App operations; with legal authorities where required by law or a valid legal request; and with app stores for payments and subscription management.
b. OpenAI Processing and Storage
Uploaded images, including any faces they contain, and the instructions needed for the requested analysis are sent to OpenAI through its API. OpenAI processes this information to return image descriptions, text suggestions, and engagement assessments. Sending an image to OpenAI constitutes sharing with a third-party service provider, even where processing is temporary. Our servers are located in Frankfurt, Germany. Images are also transmitted to OpenAI’s infrastructure for processing; our Frankfurt server location does not mean that OpenAI processing or storage is limited to Germany.
OpenAI’s separate retention practices are described in Section 6(b).
6. Data Retention and Deletion
a. General Information
We retain personal information for as long as necessary for the purposes described in this policy. Subscription and account records may be retained for applicable legal or billing obligations. You may request deletion by contacting us. Uploaded images and associated analysis information follow the more specific schedule below.
b. Uploaded Images and Face-Related Information
We delete uploaded images and associated image-analysis memory and results from systems under our control within 24 hours of upload. This deletion schedule does not override OpenAI’s separate retention practices.
OpenAI may retain API content in abuse-monitoring logs for up to 30 days under its standard practices, with legal or safety exceptions. Other service-side storage may apply depending on the features and storage settings used. OpenAI’s retention is separate from our 24-hour deletion schedule. API data is not used for OpenAI model training by default unless the customer opts in. Further details are available at https://developers.openai.com/api/docs/guides/your-data.
You may request deletion of uploaded images and associated analysis information by emailing instageniusapp@gmail.com. Requests concerning information held by a service provider are handled subject to the applicable provider controls and legal obligations. Deletion from our systems does not itself erase copies retained by OpenAI.
7. Your Rights
Depending on your location, you may have the right to access or correct personal information, request deletion, object to or restrict processing, request data portability, withdraw consent, or complain to a relevant data protection authority. These rights may apply to uploaded images and associated face-related information as well as other personal information.

8. Security
We take appropriate technical and organizational measures to safeguard information, including encryption, secure storage, and limited access. However, no system is completely secure.
9. Children’s Privacy
Genius is not intended for users under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided personal information, contact us so we can investigate and take appropriate action, including deletion where required.
10. Third-Party Links
The App may contain links to external websites, including Instagram. Their privacy practices are governed by their own policies. Please review those policies before sharing information with them. Service providers processing information for our App are addressed in Section 5.
11. Changes to This Policy
We may update this Privacy Policy from time to time. The “Last updated” date will be revised. Where required, we will provide additional notice or request consent before materially changing how personal information is processed.
