These Terms of Service govern your use of InstaGenius app. By using InstaGenius, you agree to these terms. Please read them carefully.
1. Acceptance of Terms
By using InstaGenius, you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use InstaGenius.
2. Description of Service
InstaGenius is an AI-powered social media and engagement assistant that offers the following core features:
- LikePredict
- Stalk & AI Based Instagram account character analysis
- Generate DMs
- Generate Captions
- Generate Story Replies
- AI Chatbot conversations
3. Eligibility
To use InstaGenius, you must be at least 13 years old. If you are under 18, you may use the App only with the involvement of a parent or legal guardian.
4. Account and Data Use
By using InstaGenius:
- You grant us access to process images, Instagram usernames, and any other user-generated content you voluntarily upload.
- You are responsible for the content you provide and warrant that you have the right to share any third-party Instagram usernames or images.
- You must not upload or analyze private Instagram content without the account holder’s consent.
5. Subscription & Refund Policy
InstaGenius offers subscription plans on a weekly or monthly basis, as clearly stated within the app during the purchase process. By subscribing, users authorize InstaGenius to charge the applicable subscription fee to their selected payment method. Unless the user unsubscribes before the end of the current billing cycle, the subscription will automatically renew, and the relevant fee will be collected.
Users may request a refund by contacting our support team within the applicable refund window. Each request is carefully evaluated by the InstaGenius team and is subject to review based on the user's in-app activity.
Refunds are not guaranteed and will not be granted if the user has engaged with the app following the subscription—this includes, but is not limited to, generating content, using features, or accessing any premium functionalities. Refunds are only considered for users who have not actively used the app during the subscription period.
By subscribing to InstaGenius, users acknowledge and agree to this policy, including the automatic renewal terms and refund eligibility conditions.
6. User Conduct
- Do not use InstaGenius to harass, defame, or stalk individuals in any way that violates their rights.
- You agree not to misuse the AI-generated content or interpret it as factual or legally binding.
- Analysis and predictions are for entertainment and social assistance purposes only and should not be considered psychological or diagnostic evaluations.
7. Prohibited Activities
You are expressly prohibited from:
- Attempting to access or use InstaGenius in any manner not expressly authorized by Clever App Studios.
- Reverse engineering, decompiling, or disassembling InstaGenius or its underlying technology.
- Impersonating another person or entity, or falsely representing your affiliation with any person or entity.
- Using InstaGenius for any illegal or unauthorized purpose.
- Transmitting any material that is unlawful, harassing, defamatory, abusive, threatening, obscene, or otherwise objectionable.
8. Intellectual Property
All intellectual property rights in InstaGenius, including but not limited to copyrights, trademarks, and trade secrets, belong to Clever App Studios. You may not use, reproduce, or distribute any content from InstaGenius without prior written consent from Clever App Studios.
9. Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and disclose information about you when you use InstaGenius.
10. Disclaimer of Warranties
InstaGenius is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. Clever App Studios does not warrant that InstaGenius will be uninterrupted or error-free, or that defects will be corrected. You acknowledge that your use of InstaGenius is at your own risk.
11. Limitation of Liability
In no event shall Clever App Studios be liable for any indirect, incidental, special, punitive, or consequential damages arising out of or in connection with your use of InstaGenius. Clever App Studios' total liability for any claim arising out of or relating to these Terms of Service shall not exceed the amount paid by you, if any, for accessing InstaGenius.
12. Indemnification
You agree to indemnify, defend, and hold harmless Clever App Studios and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of InstaGenius, your violation of these Terms of Service, or your violation of any rights of another.
13. Governing Law and Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law principles. Any dispute arising out of or in connection with these Terms of Service shall be subject to the exclusive jurisdiction of the courts located in Turkey.
14. Changes to Terms of Service
Clever App Studios reserves the right to modify or update these Terms of Service at any time. We will notify you of any changes by posting the new Terms of Service on InstaGenius. Your continued use of InstaGenius after any such modifications shall constitute your consent to such changes.
